From what I understand what generally happens is that if you start fighting it (especially with help from some non-profit that would like to get some case law settled) they will quickly drop the suit and return the cash. Say your cash has been out of your possession for 6 months, couldn't you make a case around loss of earnings or similar? Having a big chunk of cash tied up unexpectedly like that could cause serious cashflow issues in a small business.
